General Terms and Conditions
§ 1 Scope of application
1.1 These General Terms and Conditions (hereinafter referred to as "GTC") govern the sale and use of tickets for a one-off visit to the Boros Collection (hereinafter referred to as "exhibition") via the website www.sammlung-boros.de (hereinafter referred to as "website").
1.2 The contract for the purchase and use of the ticket is concluded between the purchaser and Boros Foundation Gemeinnützige GmbH, Reinhardtstraße 20, 10117 Berlin (hereinafter referred to as the "Organiser").
1.3 The agreements made between you and the Organiser are based exclusively on these GTC. Your general terms and conditions shall not apply. They shall not apply even if the Organiser does not expressly object to their inclusion. The contract language is German. 1.4 The GTC can be displayed and saved as a PDF. You are also authorised to print them out.
§ 2 Tickets
2.1 The Organiser sells you tickets that entitle you to visit the exhibition once.
2.2 The tickets are valid for the day and time slot specified on the ticket. The ticket loses its validity when you leave the exhibition.
2.3 The resale of the ticket to third parties at a higher rate is not permitted.
§ 3 Conclusion of contract
3.1 You can only order tickets online on the website.
3.2 A number of mandatory details (e.g. name, mobile number, e-mail address, credit card number) are required for the order (hereinafter referred to as "master data"). You warrant that the master data is correct and that you are not providing any third-party data.
3.3 You only submit a binding offer to conclude a contract for the purchase and use of a ticket by clicking on the "Submit order" button. By doing so, you also confirm the GTC. The type and number of tickets you have selected and your master data will be displayed in an overview. You can use the change buttons to correct the details.
3.4 The organiser will confirm your ticket bookings by e-mail. A binding contract between you and the Organiser only comes into effect with the order confirmation. The order confirmation is not saved by the Organiser and cannot be viewed or retrieved by you again on the website.
§ 4 Ticket dispatch
4.1 You will receive the ticket with the order confirmation as an online ticket. It is not possible to send tickets by post.
§ 5 Prices and payment
5.1 All prices quoted include the statutory value added tax.
5.2 Payment is made via PAYPAL.
§ 6 Right of cancellation
As the entitlement to visit the collection acquired with the ticket is time-limited, you have no right of cancellation (§ 312g para. 2 no. 9 BGB). www.gesetze-im-internet.de/bgb/__312g.html
§ 7 Warranty
The statutory warranty rights apply.
§ 8 Liability
8.1 The Organiser shall be liable for damages without limitation insofar as the cause of the damage is based on an intentional or grossly negligent breach of duty by the Organiser, a legal representative or vicarious agent. The Organiser shall only be liable for negligent conduct in the event of a breach of an obligation, the fulfilment of which is essential for the fulfilment of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligation), insofar as the Organiser could typically have expected the damage caused according to the circumstances known at the time of conclusion of the contract. Otherwise, the liability of the organiser - also for vicarious agents and assistants - is excluded.
8.2 The exclusions and limitations of liability provided for in Section 8.1 shall not apply in the event of injury to life, health or limb, for a defect following the assumption of a guarantee for the quality of the product and for fraudulently concealed defects.
8.3 Liability under the Product Liability Act remains unaffected, as do any statutory liability privileges in favour of the Organiser, e.g. under Sections 7 - 10 of the German Telemedia Act (TMG). 8.4 For structural or organisational reasons, individual parts of the exhibition may be closed or certain exhibits may be inaccessible. This does not entitle to a reduction of the fee. Further claims for damages are excluded in these cases.
§ 9 Data protection
The organiser processes your personal data in compliance with the statutory data protection regulations. The data will only be collected, processed and used in an automated process to the extent necessary for the contractual relationship. The organiser may transfer this data to third parties commissioned with the execution of the contract, insofar as this is necessary for the fulfilment of the contract.

§ 11 Final provisions
11.1 The Organiser reserves the right to amend these GTC at any time without giving reasons. Such changes shall not apply to bookings/orders already placed.
11.2 Should individual provisions be or become invalid or ineffective, this shall not affect the validity of the remainder of the contract.
11.3 Subject to mandatory provisions of consumer protection law, the law of the Federal Republic of Germany shall apply. The application of the UN Convention on Contracts for the International Sale of Goods is excluded. The place of fulfilment for delivery, performance and payment is Berlin. The place of jurisdiction for disputes with merchants, legal entities under public law and special funds under public law as well as persons who have their domicile or usual place of residence abroad is Berlin.
